Striking The Right Note: Retuning A National Instrument

In January 2009, the Canadian Securities Authorities’ (CSA) policy coordination committee approved a project for the revision of National Instrument 43-101, Standards of Disclosure for Mineral Projects (NI 43-101). The British Columbia Securities Commission is the lead jurisdiction with five other jurisdictions participating in the project: Alberta, Saskatchewan, Ontario, Quebec and New Brunswick. The CSA initiated the project in response to a number of industry and regulatory concerns that have developed since the CSA implemented NI 43-101 in 2001.

To help ensure that the critical issues were identified and potential solutions found, the CSA initiated a three-month consultation period which ended in April 2009. During this period, securities commissions in British Columbia, Ontario and Quebec held a series of consultation sessions with various stakeholders to discuss problem areas and concepts requiring clarification and guidance. Over 150 professionals representing a broad cross-section of the mining industry provided input, feedback and suggestions. This presentation will provide an overview of the main issues identified and potential revisions to NI 43-101.
